Welcome to Nanonet (“we,” “our,” “us”). These Terms of Service (“Terms”) govern your access to and use of our website, products, and services including website designing, digital marketing, logo designing, and hosting services (collectively, the “Services”). By using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
Use of Services
- You agree to provide accurate and complete information when engaging our Services.
- Our Services may only be used for lawful purposes and in accordance with applicable laws and regulations.
Logo Designing
1. Scope of Work
- The logo design package includes the number of initial concepts and revisions as specified in the service agreement.
- Additional revisions or concepts beyond the agreed package may incur additional charges.
2. Revisions and Approvals
- A revision refers to modifications or adjustments to the initial or subsequent design drafts based on client feedback.
- Revisions are limited to minor changes such as:
- Adjustments to colors, fonts, or layout.
- Fine-tuning elements like size, placement, or alignment.
- Replacing or refining text content within the provided framework.
- Revisions do not include creating a new concept, starting over with a different direction, or requests for entirely different designs.
Website Designing
1. Client Responsibilities:
- The client agrees to provide timely feedback, approvals, and any required assets during the development phase.
- We will develop the text content for the website and use freely available images from the internet. If the client wishes to replace or update any text, images or other content they must provide the desired content.
- Photos, graphics and individual pictures are going to be submitted by the consumer and will be changed within the applicable software system to satisfy the style needs of the positioning.
- The client agrees to provide necessary information, including product details, images, and relevant content, in a timely manner.
- Any delays caused by the client, including the provision of content and feedback, may impact project timelines.
2. Development Mode:
- The under-construction mode commences upon project initiation and continues until the completion of the website.
- The under-construction mode will be promptly disabled within 24 hours of receiving confirmation of full payment by the client.
3. Revisions and Modifications
- The project includes revisions as specified in the service agreement. Additional revisions beyond this limit will incur extra charges.
- Revisions are limited to minor changes and adjustments. Any substantial redesigns or additions will be treated as a new scope of work.
- The timeline for project completion may change depending on the level of modification requested.
4. Additional Services:
- Any additional services or features requested by the client beyond the agreed-upon scope will be subject to additional charges.
5. Third-Party Tools:
- The use of third-party tools or plugins may be necessary for specific functionalities. The client is responsible for any associated costs.
6. Access to Sensitive Resources:
- Nanonet does not provide access to sensitive resources, including but not limited to hosting accounts, server configurations, databases, and backend admin panels.
7. Termination:
- In the event of termination by the client, the client is responsible for payment for all work completed up to the termination date.
Hosting
1. Service Eligibility
- Hosting services are provided only for websites designed and developed by Nanonet.
- Hosting for third-party or externally developed websites is not permitted.
2. Managed Hosting
- Nanonet provides fully managed hosting.
- Server access (including cPanel, FTP, or control panel) will not be provided to clients under any circumstance.
- All updates, modifications, and maintenance tasks on the hosting server are performed exclusively by Nanonet’s technical team.
3. Service Scope
- Hosting includes server setup, storage, bandwidth, and performance monitoring.
- Routine maintenance, security updates, and technical optimization are included.
- Any website modification, migration, or third-party integration is handled only by Nanonet upon request and may incur additional charges.
4. Data and Backup
- Nanonet performs periodic system-level backups for internal use and disaster recovery.
- Nanonet is not liable for any data loss caused by external factors, malware, or client-side updates.
5. Usage Policy
- Hosting is intended exclusively for running the client’s website designed by Nanonet.
- Use of hosting for file storage, media streaming, or unrelated applications is not allowed.
- Excessive server load or misuse may result in temporary restriction or suspension.
6. Suspension and Termination
- Nanonet may suspend or terminate hosting if:
- Payments are overdue,
- The website violates legal or ethical standards,
- Unauthorized third-party modifications are detected.
- Upon termination, all website data and emails may be permanently deleted after 15 days.
7. Limitation of Liability
- Nanonet shall not be liable for downtime, data loss, or service interruptions caused by technical failures or external factors.
- Our total liability shall not exceed the total annual hosting fee paid by the client.
Payments & Refunds
- All services require payment as per the quotation or invoice terms.
- Work will commence only after the agreed initial payment or advance is received.
- Payments once made are non-refundable unless otherwise stated in writing.
- For ongoing services (e.g., hosting, digital marketing), renewal fees must be paid before the due date to avoid service interruptions.
Intellectual Property
- All materials, designs, and content created by us remain our property until full payment is received.
- After full payment, ownership of deliverables (such as the website, logo, etc.) transfers to the client, except for third-party resources or proprietary tools used in the process.
- Clients are responsible for ensuring that any content they provide does not infringe on third-party rights.
Confidentiality
We respect your confidentiality and will not disclose any client information or project details to third parties without written consent, except where required by law.
Limitation of Liability
We are not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our Services.
Changes to Terms
We may update these Terms from time to time. Any changes will be posted on this page with a revised effective date. Continued use of our Services after updates constitutes acceptance of the revised Terms.
